Terms of Service

These Terms govern your use of SeaYouSurf (the "Service"), operated by Not a Startup AB (SE559566425001), Sweden ("we", "us"). The Service includes our websites (seayousurf.app and app.seayousurf.app) and our iOS and Android apps. By using the Service you agree to these Terms.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your country) to use the Service.

2. The Service

SeaYouSurf provides personalised surf-spot forecasts, a community condition-reporting feature, and related content, on the web and through our mobile apps. Forecasts and match scores are estimates for general guidance only: see our Surf & Water Safety Disclaimer.

Every feature of the Service is currently available to every signed-in user. There is nothing to purchase in the apps or on our websites, and we take no payments.

3. Accounts

You can sign in with Google, with Apple (Sign in with Apple, including Apple's Hide My Email), or with a magic link sent to your email address. You are responsible for activity under your account and for keeping your sign-in method, inbox and any password secure.

If you sign in with Apple's Hide My Email, we reach you only at the relay address Apple provides. Disabling that relay in your Apple settings will stop our emails, including sign-in links, from reaching you.

You may download a copy of your data or delete your account at any time from Profile → Settings → Account → Account & data, or by emailing support@seayousurf.app.

4. Acceptable use

You agree not to misuse the Service, including: submitting false or abusive reports, scraping or overloading the Service, attempting to break security, infringing others' rights, or using the Service unlawfully.

5. Community contributions

You retain ownership of reports and content you submit, but grant us a worldwide, royalty-free licence to use, display, and aggregate it to operate and improve the Service. You are responsible for what you submit and confirm you have the right to share it.

6. Intellectual property

The Service, including its software, design, and content (excluding your contributions and third-party data), is owned by Not a Startup AB and protected by law. The SeaYouSurf name and marks may not be used without permission.

7. Disclaimers

The Service is provided "as is". Forecast data comes from third-party sources and may be inaccurate or unavailable. We do not warrant uninterrupted or error-free operation. Surfing is a hazardous activity undertaken at your own risk: see the Safety Disclaimer.

8. Limitation of liability

To the maximum extent permitted by law, Not a Startup AB is not liable for indirect, incidental, or consequential damages, or for any decision you make based on the Service. Nothing in these Terms limits liability that cannot be limited under Swedish law.

9. Apps from the App Store and Google Play

If you obtained our app from the Apple App Store, the following applies in addition to these Terms, and prevails over them if they conflict:

  • These Terms are between you and Not a Startup AB only, not with Apple. We, not Apple, are solely responsible for the app and its content.
  • Your licence to use the app is a non-transferable licence to run it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
  • Apple has no obligation to provide any maintenance or support for the app.
  • Apple is not responsible for any product warranties, whether express or implied. In the event of any failure of the app to conform to an applicable warranty, you may notify Apple and Apple will refund any purchase price paid for the app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, any failure to conform to a legal or regulatory requirement, or claims under consumer protection or similar legislation.
  • Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the app infringes intellectual property rights.
  • You represent that you are not located in a country subject to a US Government embargo or designated as "terrorist supporting", and are not on any US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, on your acceptance, will have the right to enforce them against you.

If you obtained our app from Google Play, your use is also subject to the Google Play Terms of Service, and these Terms are between you and Not a Startup AB only, not with Google.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms.

11. Governing law

These Terms are governed by the laws of Sweden, with disputes subject to the Swedish courts, without prejudice to mandatory consumer protections in your country of residence.

12. Changes

We may update these Terms; continued use after changes means you accept them.
